Disclaimer: I understand that the Vegas Tuffest Jr. World Championship may be moved to an alternate location other than Las Vegas due to unforeseen issues. I will not hold MJ Vegas Tuffest Productions LLC and all those associated with the arena liable for injuries. I am competing at my own risk. MJ Vegas Tuffest Productions LLC reserves the right to utilize photographs taken at events for advertising and promotional purposes. MJ Vegas Tuffest Productions LLC reserves the right to disqualify any contestant at a qualifier or at the Vegas Tuffest Jr. World Championship if said contestant or contestant’s family member/guardian uses profanity or any act deemed profane or unprofessional by MJ Vegas Tuffest Productions LLC towards a Vegas Tuffest Judge or Vegas Tuffest Staff member.

AGREEMENT, RELEASE AND ASSUMPTION OF RISK—MJ Vegas Tuffest Productions LLC

In consideration of being permitted to participate in the Mike and Sherrylynn Johnson Vegas Tuffest Jr. Championship in Las Vegas, NV and any qualifying events across the country (hereinafter the "Activity"), I hereby release, indemnify, and discharge MJ Vegas Tuffest Productions LLC, Mike Johnson, Sherrylynn Johnson, their agents, owners, officers, volunteers, participants, employees and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as “MJ Vegas Tuffest Productions LLC”), on behalf of myself, my children, my parents, my heirs, assigns, personal representative and estate as follows:

1. The undersigned participant, or if a minor, the undersigned participant’s parent or guardian, specifically acknowledge and agree that this Release and Hold Harmless Agreement includes, but is not limited to any and/or all liability, directly and/or indirectly resulting from the privilege afforded the undersigned participant to ride, saddle, bridle and work with any and all horses (including, but not limited to, goat tying horses, roping horses, and all other horses participating in any activity at the events). I acknowledge that my participation in horseback riding and competing in calf roping, breakaway, and goat tying entails both known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I represent that I possess the adequate skills, experience and discretion to engage in the activities anticipated during my stay upon the premises. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include, among other things: Contact with cattle, other horses and exposure to the elements. A horse, regardless of its training and usual behavior, may act unpredictably at times based upon instinct or fright which may cause you to be thrown from your horse or be injured by the horse. Horses may do such things as bite, kick, buck, lie down, or stumble. Saddles may slip and other tack or saddle problems which may develop as a result or normal use and wear. Riding a horse requires the participant to balance on the saddle. Participants may lose their balance that can result in falling from the horse. Horses may react unpredictably to cattle, ropes being thrown from them, and loud noises. I hereby agree that if my photograph is taken while participating, it may be used for such future promotional purposes that MJ Vegas Tuffest Productions LLC desires.
2. I expressly accept and assume all risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. Any product that a participant elects to use that holds or ties themselves in the saddle, including Velcro, will be solely at the participant’s risk and MJ Vegas Tuffest Productions LLC assumes no liability or responsibility.
3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless MJ Vegas Tuffest Productions LLC from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of MJ Vegas Tuffest Productions LLC’s equipment or facilities, including any such claims which allege negligent acts or omissions of MJ Vegas Tuffest Productions LLC.
4. Should MJ Vegas Tuffest Productions LLC or anyone acting on their behalf, be required to incur attorneys’ fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I assume any and all risks due to any medical or physical condition I may have.
6. In the event I file a lawsuit against MJ Vegas Tuffest Productions LLC, I agree to do so solely in the State of Oklahoma, and I further agree that the substantive law of Oklahoma shall apply in that action without regard to any conflict of law rules. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
7. WARNING. Under Oklahoma law, an equine professional is not liable for an injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities.
8. I acknowledge that this Agreement, Release and Assumption of Risk shall be operative each and every time I participate or come upon the premises of MJ Vegas Tuffest Productions LLC’s events. I may revoke this Agreement, Release and Assumption of Risk by a subsequent written notice of revocation at any time. This revocation will become effective upon delivery and acceptance in writing to MJ Vegas Tuffest Productions LLC, PO Box 1004 Stillwater, OK 74076. To participate in any future events after revocation, I will be required to sign a new Agreement, Release and Assumption of Risk.
9. The undersigned acknowledges, for himself/herself and for all persons under his/her management or control, including minor children, the inherent dangers associated with equestrian activities and the unpredictable behavior of animals such as horses and cattle, in the use and enjoyment of the facilities in care of MJ Vegas Tuffest Productions LLC or when participating in any off-premises related activity, hereby agree to use extraordinary care and prudence in his/her activities, and does further agree to abide by all rules and regulations imposed by MJ Vegas Tuffest Productions LLC and its servants, employees, instructors, organizers, officers, directors, sponsors, officials and/or anyone acting on their behalf or at their discretion.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, irrespective of and even in the case of negligence on the part of MJ Vegas Tuffest Productions LLC, I may be found by a court of law to have waived my right to maintain a lawsuit or prevail at suit against MJ Vegas Tuffest Productions LLC on the basis of any claim from which I have released them herein. I have read and understood the above and foregoing Agreement, and I agree to be bound by its terms.

PARENTS OR GUARDIAN’S ADDITIONAL INDEMNIFICATION completed for participants under the age of 18
The foregoing minor, , is under my care, control and custody. Said Minor being permitted by MJ Vegas Tuffest Productions LLC, at my request and with my consent, to participate in its activities and to use its equipment and facilities. I have read the above Agreement, Release and Assumption of Risk, and I assent to all terms therein on behalf of myself and on behalf of Minor. I further agree to indemnify and hold harmless MJ Vegas Tuffest Productions LLC from any and all Claims which are brought by, or on behalf of Minor, and which are in any way connected with such use or participation by Minor.
